General Sales Conditions


I - Scope and Modifications to the General Sales Conditions

These General Sales Conditions apply to all orders submitted using the web site mywikango.com. ALERTEGPS Software reserves the right to adapt or modify these General Sales Conditions at any time. Should these Conditions be modified, the General Sales Conditions in force on the date of the order will apply.

These General Conditions will take effect on the date on which the order form is signed. These General Conditions are concluded for the duration required to supply the goods and services subscribed, until the expiry of the warranties provided by ALERTEGPS Software.

II - Service availability

Our service ranges and prices are valid if visible on the site.

Definition of the date of confirmation of the order:
- the date of the order if the amount is paid on-line by credit card.

The service may not be legal in some jurisdictions. You understand and accept that the Company is unable to provide you with any legal advice or assurances in respect of your use of the Services and the Company makes no representations whatsoever as to the legality of the Services in your jurisdiction. Please verify the relevant laws in your jurisdiction before registering with the Company and using the Services.

The Services are intended only for users who are not prohibited by the laws of any applicable jurisdiction. The Company does not intend to enable you to contravene applicable law. You represent, warrant and agree to ensure that your use of the Software and the Services will comply with all applicable laws, statutes and regulations. The Company shall not be responsible for any illegal or unauthorized use of the Software and/or the Services by you. Please consult legal counsel in the applicable jurisdiction if you have any doubts about the legality of your use of the Software and the Services under the laws of any jurisdiction that applies to you. By accepting these terms, you agree to assist the Company, to the extent you are able, with its compliance with applicable laws and regulations.

III - Confirmation of orders and electronic signatures

All order forms signed by the consumer in the form of a mouse click are irrevocably accepted and can only be modified within the limits defined in these General Sales Conditions.

The mouse click combined with the authentication procedure, non repudiation and the protection of the integrity of messages represents an electronic signature. This electronic signature has the same value between the parties as a handwritten signature.

IV - Price

ALERTEGPS Software reserves the right to modify its prices at any time, but will apply the current rates indicated at the time of order, subject to availability on this date.

V - Means of payment and Securitisation

You may make payments:

- by bank card: Payments can be made using the secure bank server of our partners (HSBC, Ogone and Wirecard). This implies that none of your personal bank information transits via the ALERTEGPS Software site. Bank card payment is a 100% secure system; your order will be registered and confirmed from the acceptance of our bank. Your order will be confirmed immediately by our bank partner and will be debited within 48 hours.

Securitisation: The details of your credit card are encoded using the SSL (Secure Socket Layer) protocol and never transit via the internet in plain text. Payment is made directly to our bank. ALERTEGPS Software cannot access these details under any circumstances, and will not save these details on its servers. For this reason, you must re-enter your card details for each order on our site (except if you use an alias, see below).

Alias: The website mywikango.com offers the possibility to use an alias for the payments. An alias is a nickname that is associated to the details of your credit card. ALERTEGPS Software will only keep the alias on its servers, and not the details of the credit cards. An alias allows you to use the One Click Payment service, i.e. pay orders by indicating the alias only. This method can be used both on the website and on the compatible devices.

An alias can be cancelled by clicking on the dedicated link in the account section of the website.
Users can also send a request to contact@mywikango.com.

Non-payment: ALERTEGPS Software reserves the right to refuse to deliver a service to or accept an order from a consumer with an outstanding amount from a previous order or for which payment litigation is pending.

Please note that ALERTEGPS Software does not make automatic subscription renewals: Customers will receive a message when the expiry date of the service they have subscribed to approaches, but no automatic renewal is made.

VI - Liabilities

ALERTEGPS Software cannot be held liable for non-performance of the contract concluded due to contingencies, force majeure, disturbance and partial or total striking, particularly by postal and/or transport and/or communications services, flooding or fire. With regard products purchased to satisfy professional requirements, ALERTEGPS Software cannot be held liable for any indirect damages caused by these articles, operating losses, loss of earnings, damages or costs incurred.

The customer is sole liable for the selection and purchase of a product or service. Should partial or total use of the products not be possible, particularly due to incompatible hardware, no compensation or reimbursement may be claimed from ALERTEGPS Software and the latter may not be held liable

Should an order not be delivered, in part or in whole, you must submit a claim within a maximum of 30 days (from the date of departure from our warehouses). Beyond this period, no claims will be accepted.

VII - Provisions of the law on "IT and freedoms"

Customers may "access, modify, rectify or delete personal data" (art. 34 of the law on "IT and freedoms" of 6 January 1978) at any time. You may also receive proposals from other companies via our intermediary. Should you not wish to receive such proposals, simply send us an e-mail at contact@mywikango.com. You can also send a request to our services by mail to ALERTEGPS Software – 1 rue Bayard – 59000 Lille.

VIII – Refund Policy

Therefore, we do honor requests for the refund on the following reasons:
• download / incompatibility issues: it may happen so that you are having problems while downloading the product or encounter an issue on a device that has not been specified as a compatible device. Claims regarding such issues must be submitted to contact@mywikango.com within 48 hours ; Thank you for purchasing our services.
